These Terms of Use ("Terms") govern your access to and use of ComicKnit, an AI-powered comic creation and publishing platform ("Service"), operated by Airmeet Inc. ("Company," "we," "us," or "our"), a corporation registered at 440 N Barranca Ave #5787, Covina, California 91723, United States.
By creating an account or using ComicKnit in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years of age to use ComicKnit. By using the Service, you represent and warrant that you meet this age requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly collect personal information from children under the age of 13. If we become aware that a user is under 13, we will promptly terminate their account and delete any associated data.
2. Account Registration
To access certain features of ComicKnit, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your account credentials confidential and not share them with others.
- Notify us immediately at legal@airmeet.com if you suspect unauthorized access to your account.
- Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.
3. The Service
ComicKnit allows users to:
- Create comics and graphic stories using AI-powered generation tools.
- Save comics privately without publishing them to the community.
- Optionally publish comics to the ComicKnit discovery feed for other users to read, like, bookmark, and comment on.
- Interact with the community through comments and messaging features.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
4. Intellectual Property and Content Ownership
Your Content
You retain full ownership of the comics and other content you create on ComicKnit ("Your Content"). By using the Service, you grant Airmeet Inc. a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and distribute Your Content solely for the purpose of operating and improving the Service.
This license does not transfer ownership of Your Content to us. You may delete your content or account at any time, subject to the terms in Section 10.
AI-Generated Elements
ComicKnit uses third-party AI services to generate visual and narrative elements based on your prompts and inputs. You acknowledge that the originality, copyright, and enforceability of AI-generated outputs may vary under applicable law, and you agree that you are solely responsible for ensuring any content you publish complies with applicable intellectual property laws.
Our Intellectual Property
All elements of the ComicKnit platform, including but not limited to the website, application, branding, design, software, and underlying technology, are owned by or licensed to Airmeet Inc. and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary materials without our prior written consent.
5. Prohibited Content and Conduct
When using ComicKnit, you agree not to create, upload, publish, or share content that:
- Contains sexually explicit, pornographic, or adult material.
- Promotes hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Infringes the intellectual property rights of any third party, including using copyrighted characters, logos, or artwork without authorization.
- Depicts real, identifiable people in a defamatory, misleading, or non-consensual manner, including deepfake-style or impersonation content.
- Contains threats, violent incitement, or material that promotes harm to any person or group.
- Violates any applicable law or regulation.
You also agree not to:
- Use the Service to scrape, harvest, or collect data about other users without consent.
- Attempt to reverse-engineer, hack, or otherwise interfere with the platform.
- Use automated bots or scripts to create content or interact with the community.
- Impersonate any person, entity, or the Company.
We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts of users who repeatedly or egregiously violate them.
6. Community Standards
ComicKnit is a creative community. When interacting with other users through comments or messaging, you agree to engage respectfully. Harassment, bullying, spamming, or any behavior intended to intimidate or harm other users will not be tolerated and may result in immediate account suspension.
Users must explicitly choose to publish a comic for it to appear in the public discovery feed. Private comics are not visible to other users.
7. Payments and Subscriptions
Creator Bundles
Comic creators may purchase content bundles or credits through the Service. All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy. Airmeet Inc. does not store your full payment card details.
Refunds
All purchases are final unless otherwise required by applicable law. If you believe you have been charged in error, please contact us at legal@airmeet.com within 14 days of the transaction.
Future Reader Subscriptions
We may introduce subscription plans for readers in the future. Any such plans will be announced with advance notice, and separate terms may apply at that time.
Taxes
You are responsible for any applicable taxes on your purchases. Prices displayed may not include applicable taxes, which will be calculated and shown at checkout.
8. Third-Party Services
ComicKnit uses third-party services to deliver its features, including AI generation tools, payment processors, and analytics providers. These third parties operate under their own terms of service and privacy policies. We are not responsible for the practices of third-party services, and we encourage you to review their policies.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Airmeet Inc. disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Airmeet Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from these Terms or the Service will not exceed the greater of (a) the amount you paid to us in the twelve months prior to the claim, or (b) one hundred US dollars ($100).
11. Account Deletion and Content After Deletion
You may delete your account at any time by visiting your account settings or contacting us at legal@airmeet.com. Upon deletion:
- Your account and associated personal data will be removed in accordance with our Privacy Policy.
- Comics you have previously published to the community discovery feed may remain visible to other users after your account is deleted. If you wish to remove published comics before deleting your account, please do so prior to submitting your deletion request.
12. Termination by Us
We may suspend or permanently terminate your access to the Service at our discretion, with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Service immediately ceases.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the Service prior to the change taking effect. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
